(Use of Personal Information) At eobituary.com your personal information also defines your wish to create a meaningful and respectful memorial of your loved ones. Your inputs (both graphical and textual contents) must not contain material, which is unlawful, obscene, offensive, defaming, scandalous, vengeful, threatening, hateful, embarrassing or even discriminating against the deceased or anybody related to the deceased. Your chosen words in the memorial pages should not provoke or encourage unlawful behavior. Only accurate and honest information are deemed acceptable. Every created memorial must be with the full permission and approval of family members. In case of celebrity memorial no defamatory, libelous or unfavorable material must be submitted. All controversial or unauthorized materials will be removed at any time upon receiving a complaint and review judgment by our administrative staff. Any jpeg or other graphic format files submitted to eobituary.com for the memorials or obituary listings or any other purpose shall not bear any distortion, digital tampering or pornographic motifs. If so, eobituary.com reserves the right to delete such files and shall have the right to question the intent of the member. Eobituary.com reserves the right to request for an acceptable replacement of the graphic file / files. If no alternative file is submitted of the member is found to be of a wrong intent, eobituary.com shall reserve the authority to remove all content inputs of the member from its database and shall not be obligated to give a refund to the customer. We take no responsibility as author of content created by members that are deemed by others as harassment or defamation of the deceased or the memory of the deceased. Eobituary.com may notify the creator of memorial about the complaints and give ample time to modify such content offensive to other users. We reserve the right to delete such offensive content if the user does not do it himself or herself within a reasonable time using the available online editing tools.

GENERAL:

The terms and conditions outlined above are designed to protect and benefit all members and customers. In particular, they attempt to ensure that the web site is used only for legal, ethical and appropriate purposes. This agreement represents the complete agreement and understanding between Eobituary.com and the account holder (herein called Member) and supersedes any other written or oral agreement. Upon notice published online via eobituary.com services, eobituary.com may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change services offered. Eobituary.com requires that its agreements be made with a person who is qualified to contract. As such, customer must be over the age of eighteen years. Otherwise, a parent or guardian must accept this agreement and enclose the proper payment. Eobituary.com cannot accept payments from persons who are not at least eighteen years of age. LIMITATION OF LIABILITY: The customer agrees to indemnify and hold eobituary.com and any of its associates harmless from any claims resulting from the use of the service, including claims relating to damage to the member, relatives, friends of the deceased and the deceased through online memorial tributes, or to any other party.

USE OF SERVERS:

Customers should not attempt to access the web pages of other members unless no password is requested (thereby accessible to general public via links), and should not attempt to hinder the operation of our web site functionality and operation in any way. We reserve the right to refuse or cancel service to any customer. The customer/member/user agrees to indemnify and hold eobituary.com and any of its associates harmless from any crime committed against the server data which eobituary.com has not control over. For example, internet fraud crimes any server may be susceptible to, such as, stealing, e-data or copying, altering, or destroying e-data, e-files or e-programs. In summary, eobituary.com will perform all reasonable effort to maintain the operation and functionality of the web site but is not liable for criminally accessed e-data even with reasonable effort to secure data with firewalls and other security measures, that is copied, altered or destroyed by digital viruses, worms and other destructive digital codes. Eobituary.com is not liable for e-data accidentally lost or destroyed by the websites host server.

USE OF DISK SPACE:

Price payment includes maintenance for set period total amount of disk space necessary for memorial entity. Notice will be given by email only in regards to upcoming required fees to extend contracted time for maintaining memorial entity online. It is the responsibility of the Member/user to update personal contact information with eobituary.com to sustain files online. If there is no response to a second and final notice, eobituary.com has the right to delete memorial pages and virtual cemetery sites. The alternative of maintaining online indefinitely selected pages and cemetery sites, without further payment by the member, is left to the discretion of eobituary.com. Eobituary.com makes no claim to copyright ownership of member submitted graphics or text content. Such remains with the inputting member. However all site programming and web site graphic design elements remain the copyright property of eobituary.com and Creative Frontiers International Corporation.

CHAT ROOMS

Server side based Chatrooms tend to monopolize system resources and for that reason we do not allow customers to use this type of chat room. SPAM (Unsolicited Bulk email) Spamming, or sending of unsolicited bulk email from eobituary.com and its server is strictly prohibited. Additionally, you must not use an email address or domain name which is hosted by eobituary.com to send unsolicited bulk email. If we decide that you have violated this condition then your account will be deactivated immediately and without refund for any paid services.
